Conditions of participation and data protection

1. the promoter of the promotion is the city of Bocholt, Kaiser-Wilhelm-Straße 52-85, 46395 Bocholt.

2. this promotion is not connected to Instagram and is in no way sponsored, supported or organised by Instagram. The recipient of the information provided is not Instagram, but the city of Bocholt.

5 All persons resident in Germany who are at least 18 years old at the time of their participation are eligible to participate. Legal representatives and employees of the organiser as well as their relatives and other third parties connected with this event are excluded from participation. 6.

Participation is only possible within the campaign period (until 06.10.2023, 12 noon) and exclusively via the Internet. Participation is free of charge and the participant does not enter into any contractual or other legal obligations. 7.

Participation is free of charge. Participation and chances of winning are not dependent on the purchase of a product or service.

10) All participants will be entered into a draw to win 8 strolling bags worth approx. 50 euros each.

The Promoter reserves the right to modify, suspend or discontinue the Game and the Prize Draw in whole or in part without prior notice in the event of unforeseen circumstances. (14) If a Participant breaches these Terms and Conditions or provides inaccurate information, the Promoter may exclude the Participant from participation without having to give reasons for doing so.

(15) The organiser shall be liable to the participant in accordance with the statutory provisions for damages arising from injury to life, limb or health that are based on an intentional or negligent breach of duty and for other damages that are based on an intentional or grossly negligent breach of duty and fraudulent intent. In addition, the organiser shall be liable for damages covered by liability under mandatory statutory provisions such as the Product Liability Act, as well as in the event of the assumption of guarantees. In all other cases, the organiser shall only be liable for slight negligence if it, its legal representatives, executive employees or other vicarious agents breach a contractual obligation, the fulfilment of which is a prerequisite for the proper performance of the contract, the breach of which jeopardises the achievement of the purpose of the contract and on the observance of which the participant could regularly rely. Should individual provisions of these conditions of participation be or become invalid, inadmissible or unenforceable, this shall not affect the validity of the remaining conditions of participation. The invalid, inadmissible or unenforceable clause shall be replaced by provisions whose effects come as close as possible to the economic objective. Any rights arising from the legal relationship on which these conditions of participation are based are not transferable by the participant to third parties. The law of the Federal Republic of Germany shall apply. Legal recourse is excluded.
